In Falmouth, whether your septic has spare capacity decides the budget
Falmouth permits one ADU by right in every single-family district, on a building permit, with no site plan review. Then the Board of Health nitrogen regulation decides whether the job costs $25,000 to $40,000 more — and it turns on one word in a definition.
Falmouth’s bylaw says accessory dwelling unit. Around East Falmouth and Waquoit people say in-law apartment, or backyard apartment for a detached cottage. All three run into the same septic question below.
“New Construction shall only include an Accessory Dwelling Unit IF THERE IS AN INCREASE IN THE ACTUAL OR DESIGN FLOW of the property.”
If any part of your lot sits in a Nitrogen Regulated Area, all New Construction must carry Best Available Nitrogen Reducing Technology — an innovative/alternative septic system at 10 mg/L. But an ADU is only New Construction if design flow goes up. A three-bedroom house sitting on a four-bedroom system has spare capacity, so a one-bedroom ADU adds no design flow and escapes the requirement entirely. A two-bedroom ADU breaks it. That single question — spare capacity or not — is worth more than every zoning provision on this page, and it is the first thing we go and establish.
The map that state data will not answer
The Nitrogen Regulated Area is a local Board of Health boundary. Clear state layers do not clear it, and a parcel can sit outside every MassDEP resource area and still be inside Falmouth’s regulated area.
Falmouth Board of Health Regulation, Nitrogen, requirement 2We will be straight that we cannot tell you from a desk whether your parcel is inside it. That is a Board of Health reading, and it is on the list for the site visit rather than something to guess at here.
Where an ADU is allowed
- Permission
- By right in every Single-family Residential Zoning District. One ADU per lot. Building permit only.s.240-9.1A(1); s.240-9.1D(2)
- Site plan review
- Not required. A protected-use ADU is expressly exempt from s.240-12.2.s.240-9.1C(4)
- Where the bylaw sits
- Chapter 240, Article 9, s.240-9.1 — purpose, definitions, right to construct, requirements and limitations.s.240-9.1
Falmouth is unusually clean on process. The published text is also current: the eCode edition already carries the 17 November 2025 Fall Town Meeting Art. 22 amendment, AG-approved 31 March 2026.
s.240-9.1 headnoteHow big — and here your basement counts against you
The smaller of 900 square feet or 50% of the gross floor area of the principal dwelling.
s.240-9.1D(5)For the ADU calculation only, Falmouth defines gross floor area as the sum of all storeys of compliant ceiling height including basements, lofts and intermediate floored tiers, measured from the interior faces of exterior walls — while excluding crawl spaces, garage parking, attics and enclosed porches. So a finished walkout lower level counts toward your 900 square feet here. In a town whose definition excluded basements it would be free area. This definition applies only to s.240-9.1, which is careful drafting and worth knowing.
Parking, and the definition that helps you
One off-street space if the ADU is outside a half-mile radius of a Transit Station; none inside it. Falmouth then defines Transit Station broadly — a subway station, commuter rail station, ferry terminal or bus station, and expressly “includes, without limitation, the embarkation points for the Cape Cod Regional Transit Authority and The Steamship Authority.”
s.240-9.1B; s.240-9.1D(10)That is a wider definition than the state’s, and it works in your favour: CCRTA embarkation points and the Steamship Authority terminals put a good deal of Falmouth inside a half-mile radius owing no additional space at all. Where a space is required it must be on the premises it serves — not off-site, not on Town property, and not within the roadway right of way.
s.240-9.1C(5)Setbacks in SR-C, and the front-yard trap
| Yard | Requirement |
|---|---|
| Front | 25 ft — and an accessory structure in a FRONT yard needs a ZBA special permit and may not sit closer than 50 ft to the street frontage |
| Side | 10 ft for an accessory structure larger than 100 sq ft |
| Rear | 10 ft for an accessory structure larger than 100 sq ft |
The front yard is where Falmouth is strict rather than generous: putting a detached unit in front of the house is a special-permit exercise and a 50-foot standoff, so on a shallow lot the unit goes behind or beside the house or it does not go.
One honest note on districts: whether the assessor and GIS code “RC” is the adopted bylaw’s SR-C is something we confirm against the adopted map for your parcel rather than assume.
Short-term rental — and it reaches your own house
No ADU may be operated as a short-term rental at any time. And on any lot that contains an ADU, neither the principal dwelling nor the ADU may be used as a Commercial Accommodation at any time.
s.240-9.1D(3) and (4)On Cape Cod that is the single most consequential condition on this page for a lot of owners. If summer letting is any part of your plan for either building, read this provision before anything else — adding an ADU changes what you may do with the house you already have.
What we cannot settle from a desk
Three things about Falmouth are genuinely open and we would rather say so than paper over them:
- Nitrogen Regulated Area
- Whether your specific parcel lies inside the Board of Health boundary. This is the one that moves the budget.Board of Health reading, per parcel
- WRPOD impervious
- Which impervious figure governs an ADU in the Water Resource Protection Overlay District, and whether the test is total lot impervious or only the increment added.s.240-7.7 — figures conflict
- WRPOD density
- Whether the WRPOD density restrictions — 80,000 sq ft minimum lot, 200 ft width, 150 ft frontage — can be applied against a protected-use ADU on an existing undersized lot. We think not, but it has not been tested.s.240-7.7B(5) against 760 CMR 71.03
All ADU construction must in any case comply with Title 5 for a single-family dwelling in the district where the ADU sits.

Southcoast Building is an approved Feasibility Study Provider under the Massachusetts Housing Partnership ADU Incentive Program. A licensed builder walks your property, reads your parcel against the bylaw, checks the septic and the grading, and tells you whether an ADU works here and roughly what it would cost. Thirteen of our studies have been approved by MHP to date.

Zoning changes, and a building inspector’s reading of it is the one that governs your permit. Nothing here is a determination about your property. It is what the adopted text and the Attorney General’s decisions say as of 8 September 2026.
