Brockton lets you build on a 5,000 square foot lot, which is most of Brockton

Brockton has a post-Act ADU provision with protected-use language on the books. The thing that makes this city genuinely workable for accessory dwellings is older and quieter: Sec. 27-12 allows a single-family dwelling on any existing lot of record below the minimum area or frontage — down to 5,000 square feet and 50 feet of frontage, with six-foot side yards.

The ordinance says accessory dwelling unit. In Campello and Montello the words are usually in-law apartment, or backyard apartment for a unit behind the house. On Brockton’s small lots the protection below is what makes any of them possible.

Small-lot protection · Sec. 27-12

A single-family dwelling may be built on any existing lot of record below the minimum area or frontage — 50 ft of frontage and 5,000 sq ft of area, with side yards of 6 ft interior and 10 ft adjacent to a street.

Brockton’s housing stock is dense and its lots are small, and a great many of them are under the district minimum. Sec. 27-12 means that is not a disqualifier — provided there is no adjacent commonly-owned vacant land that would make up a conforming lot, the zone’s front and rear yards are maintained, and there is off-street parking for one vehicle. A six-foot interior side yard on a 5,000-square-foot lot is a workable envelope for a compact detached unit, which is not true in most of the surrounding towns.

Sec. 27-12 and Sec. 27-12(5), Brockton Code of Ordinances App. C

What the ordinance carries

Parking
One additional space where the lot is outside a half-mile radius of a commuter rail, subway or bus station. Brockton has commuter rail at Brockton, Montello and Campello, so a great many parcels fall inside a radius and owe nothing.Sec. 27-35.2(e)(6)
Protected use
The held Appendix C text carries protected-use language with 2024 and 2025 dates, so a post-Act provision is genuinely published.Code of Ordinances App. C, 8 accessory-dwelling hits
Small lots
5,000 sq ft and 50 ft frontage, side yards 6 ft interior and 10 ft adjacent to a street, subject to the Sec. 27-12 conditions.Sec. 27-12; Sec. 27-12(5)
Brockton is a city, so check currency differently

There is no Attorney General review of city ordinances under G.L. c.40 §32, so the AG index is not the check here — the supplement currency date is. The text we hold carries the protected-use language, but we confirm the supplement date with the City Clerk before quoting any figure from it. A download stamp is not an adoption date.

The three station radii, and why they matter here

Brockton’s parking rule keys on distance from a commuter rail, subway or bus station, and the city has three commuter rail stations along the Middleborough line — Brockton, Montello and Campello — plus the BAT Centre intermodal terminal. Between them, a substantial share of the city’s residential parcels sit inside a half-mile radius.

Sec. 27-35.2(e)(6); 760 CMR 71.02 defines Transit Station

Where your parcel falls inside one, no additional parking space is required at all. On a small Brockton lot that is not a minor saving — a required space and its access can be the difference between a unit fitting and not fitting. It is worth measuring precisely rather than assuming, and it is one of the first things we establish.

How big it can be

900 square feet or half the gross floor area of your house, whichever is smaller, under the state protected-use standard.

760 CMR 71.02

The state definition at 760 CMR 71.02 governs the size of a protected-use ADU, and a local definition cannot shrink a state entitlement. We compute the half-GFA figure on the state definition and carry the local number alongside it, because a local official may well reach for the local one.

On Brockton’s typical two-family and smaller single-family housing stock, the half-of-GFA test is usually what binds rather than the 900. A 1,400-square-foot house yields 700 square feet, not 900. Work your own number on the ADU size calculator.

Setbacks

The Sec. 27-12 small-lot figures above — 6 feet interior side, 10 feet adjacent to a street, with the zone’s front and rear yards maintained — are the ones that matter on an undersized lot, and undersized is the Brockton norm.

Sec. 27-12

For a conforming lot, the district setbacks that apply to your parcel are read off the adopted dimensional table for your specific district, and we do that on your address rather than print a number here that may not be yours. The provision to have in hand either way is 760 CMR 71.03(3)(b)(2): a town may not impose dimensional standards on a protected-use ADU that are stricter than those for a principal dwelling.

Sewer, and what that takes off the table

Brockton is on municipal sewer and water throughout. That removes the Title 5 design-flow question that dominates ADU feasibility in the surrounding towns — no septic capacity test, no bedroom-count ceiling imposed by a leaching field, no $40,000 system replacement lurking in the budget. What replaces it is a connection and capacity question, which is almost always the cheaper problem.

Combined with the small-lot protection and the transit radii, that is what makes Brockton one of the more straightforward cities on our list to build an accessory unit in. Planning ranges are in our cost guide.

We will tell you whether it works before you spend anything

Southcoast Building is an approved Feasibility Study Provider under the Massachusetts Housing Partnership ADU Incentive Program. A licensed builder walks your property, reads your parcel against the bylaw, checks the septic and the grading, and tells you whether an ADU works here and roughly what it would cost. Thirteen of our studies have been approved by MHP to date.

Where these figures come from

  1. City of Brockton Code of Ordinances, Appendix C (Zoning) — Sec. 27-12 and Sec. 27-12(5) (existing lots of record), Sec. 27-35.2(e)(6) (ADU parking). Held text searched in full 2 September 2026: 8 accessory-dwelling hits including protected-use language and 2024 and 2025 dates. Supplement currency date to be confirmed with the City Clerk.
  2. 760 CMR 71.00 — §71.02 defines Transit Station and gross floor area; §71.03(2)(b) parking cap; §71.03(3)(b)(2) bars dimensional standards stricter than those for a principal dwelling.
  3. Brockton is a city, so its ordinances are not submitted for Attorney General review under G.L. c.40 §32 and no AG decision exists to check against.
  4. Brockton is served by municipal sewer and water throughout, so 310 CMR 15.000 (Title 5) does not constrain the bedroom count as it does in the surrounding towns.

Zoning changes, and a building inspector’s reading of it is the one that governs your permit. Nothing here is a determination about your property. It is what the adopted text and the Attorney General’s decisions say as of 8 September 2026.
